1. Who is responsible?

2. Which data is collected for which purpose?

Depending on the purpose, we collect information, such as

• title, first name, last name, address
• a valid e-mail address
• Telephone number (fixed line and/or mobile)
• Information necessary for the assertion and defense of your rights under the mandate

The collection of this data is carried out in order to

• identify you as our client;
• be able to advise and represent you appropriately;
• correspond with you;
• process your requests or applications for employment
• invoice our services;
• process any existing claims and assert any claims against you;

Any data processing is based on your request and is in accordance with Swiss Data Protection Law and GDPR for the stated purposes, for the mutual fulfillment of obligations, processing requests, application and the mandate contract.

Personal Data collected for purposes other than serving a contractual relationship shall be retained as long as needed to fulfil such purposes or required by law.

The personal data collected by us for the purposes of mandate or employment will be stored and deleted until the expiry of the statutory retention obligation (10 years after the end of the calendar year in which the mandate was terminated), unless that in accordance with Swiss Data Protection Law and GDPR required to be stored for a longer period on account of tax and commercial duties of storage and documentation (from the Swiss Constitutional Law) or you provided your consent.

3. Transfer to third parties

A transfer of your personal data to third parties for purposes other than those listed above does not take place. If a transfer is required for the purposes of mandate, your personal data will be passed on to third parties.

This includes, in particular, passing on to service providers, such as those for pacing annual fees, national representatives, opponents of proceedings and their representatives (in particular their lawyers) as well as courts and other public authorities for the purpose of correspondence and to assert and defend your rights.

The transferred data may be used exclusively for the stated purposes.

The attorney (or patent attorney) – client-privilege obligations remain unaffected. As far as data are concerned, which are subject to the attorney (or patent attorney) – client privilege, a transfer to third parties takes place only with your consent.

4. What rights do you have?

You have the following rights

• You can revoke your once given consent at any time;

• You can request information about your personal data processed by us. In particular, you can demand information on the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed, the envisaged storage period, the existence of automated decision-making, including profiling, and, where appropriate, meaningful information about their details. You have the right to rectification, deletion, restriction of processing, to object to such processing and to lodge a complaint. Where the personal data are not collected by us, you can demand any information as to their source;

• You can demand without undue delay the rectification of inaccurate personal data or the completion of incomplete data;

• You can request to obtain the erasure of your personal data stored by us, except as far as the processing is required for exercising the right to freedom of expression and information, for the fulfillment of legal obligations, for reasons of public interest or for assertion, exercise or defense of legal claims;

• You can demand the restriction of the processing of your personal data, as far as the accuracy is contested, the processing is unlawful, but you oppose the erasure, we no longer need the data but they are required for the establishment, exercise or defense of legal claims or you have objected to processing according to GDPR;

• You can request your personal data provided to us, in a structured, commonly used and machine-readable format and to transmit those data to another controller;

• You can lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or place of the alleged infringement

5. Right to object

If the processing of your personal data is based on legitimate interests according to GDPR, you have the right to file an objection against the processing of your personal data according, as far as reasons arising from a particular situation are given. 6. Security

We implement appropriate technical and organizational safeguards to protect against unauthorized or unlawful processing of Personal Data and against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data. Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of Personal Data.
